Observation Benchmarks II

a. Mifos X is the Intellectual Property(IP); renamed to Apache Fineract and donated to Apache Software Foundation. Mifos X was initially fiscal sponsored by Software Freedom Conservancy.

b. License of Mifos X has been changed from MPL 2.0 to Apache 2.0 during this transition.

c. Community governance model changed from Mifos Foundation to Apache way.

d. Most of the IP dependent applications are still licensed under MPL 2.0 and maintained by Mifos Foundation.

e. The IP discussions are connected and documentations have been assessed to be highly scattered.

 

 

For making assessments for IP clarification of componentized Intellectual Property rights of contributors, and roles and responsibilities of stakeholders:

 

  1. Identify purpose and intent of Grameen Foundation, USA ( a 501c(3) US organisation, (with sister legal bodies in India, Ghana, Kenya, Philippines, Uganda) for assigning and transferring an open source Intellectual Property to a restricted 501c(3) organisation, without legal bases in jurisdictions outside USA?

  2. What are the solution licensing and third party open source licensing compatibility practices, followed through the tripartite sequential assignments between Grameen Foundation, Mifos Foundation and Apache Software Foundation?

  3. Have the governance board members of Mifos Foundation taken cognisance off any objections to the assignment of Intellectual Property rights between Mifos Foundation and Apache Software Foundation?

  4. Have the governance board members of Apache Software Foundation taken cognisance off any objections and breach of public trust in regards to the assignment between Mifos Foundation and Apache Software Foundation?

  5. Have the governance board members of Grameen Foundation taken cognisance off any objections and breach of public trust in regards to the assignment between COSM and Mifos Foundation?

  6. Are there instances of contributions/submissions of code, triage and documentation to the source code where;

    Work submitted without the original author(s) having signed a CLA, and

    Work is submitted under the false pretexts, title or author origins?

    If Yes, please list the PRs here, and

    If yes, list the contents of PMC Board Report, identifying PMC’s cognisance of these contributions.

    1. In the context of this observation report, most early deployments and project dependence has been assessed to be linked to the original COSM and then Mifos community, including project dependence(refer: Fineract Project Maturity Evaluation Report).

    2. Identify and describe (long term) Intellectual Property clarification plans and a governance model for application lifecycle between two projects Apache Fineract(donated Mifos X)( governed by the governance model of ASF, and released with Apache 2.0 license) and Mifos distribution(presentation layer applications)(released with Mozilla license and governed by Mifos Foundation).

       

      Whether or not, the PMC of project Fineract have identified project dependence on private influencers?

       

      1. If yes, identify and describe the scope of affiliation and mandatory disclosure requirements on disclosing dependence on private ‘’for profit’’ entities in the public charity project?

      2. If yes, identify and describe (long term) Intellectual Property clarification plans between ASF and private ‘’for profit’’ entities in the ASF’s public charity project?
